My husband and I are on the process of getting a divorce. Now I'm back on my parent’s house because I need a company and someone that I can talk to. One thing that bothered me a lot is the free divorce advice article that I read on the internet. One of their advices is not to leave the marital home for I may run the risk of losing my claim on the home. How true is this? I hate to see my husband and continue staying with him. What am I going to do? Need some advice.

HI Brokenpieces lovely to meet you, but I am so sorry to hear you are going through this bad time.

I was thinking about what you said and it is a hard one to answer correctly I must ask where are you living at the moment? is your home in the UK? Also sorry to ask but is the house in both your names?

In the UK we have the CAB Citizens advice bearu (sorry I cant spell that word ) where we go for free advice, Do you have that where you live? Is there anyone you can ask for advice for free?

I cant see this as being true myself, As imagine that a woman lives with a partner who is abusive there is NO WAY the government could expect her to stay there, There are all forms of abuse and during divorce I can imagine it is impossible to be around your Ex partner I'm sure they must take this into account?

I think you have done the right thing getting away from your partner, you MUST do what is right for you. I wish I could somehow solve this for you, It is hard not knowing what country you are in.

Hi Brokenpieces,
Firstly thank you for joining our forum. secondly I'm so sorry to hear you are going through a difficult time right now.

Well, this is a hard one to answer, because I am not sure what country you are in? With each country, rules differ. Here in the UK, yes as far as I know (but dont hold me to it) i think there is some truth in what you have read.
Obviously it depends whether the ex is violent/ abusive & it would be dangerous for you to stay in the same enviroment.

I believe here at least, that is why my cousin stayed in the same house as her ex husband, as awful as it was, because of losing claim to the house.
If you are in the Uk, I will try & find some more info for you. But it would be pointless if you are not in the UK, as what stands here, will be different elsewhere sadly

Can you not speak to a solicitor? I know these things can be costly...so if not do you have a free advice type centre? We have what is called the C.A.B here (citizen's Advice Bureau) where you can make an appointment & get advice on most matters, free & confidential. But again, depends where you live.

You certainly do need to speak to someone who deals with this kind of thing, to make sure where you stand. The sooner the better.
